01 Agreement to terms

This Terms of Service agreement ("Terms") is a binding contract between you ("you" or "your") and webscrape.ai ("webscrape.ai", "we", "us", or "our") and governs your use of our website, dashboard, API, and related services (together, the "Services").

By creating an account, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

02 The Services

webscrape.ai is a web scraping and data-extraction platform that converts web pages into clean, schema-validated structured data through a single API. The Services include URL fetching, content cleaning, AI-based extraction, web search, and related dashboard tools.

We may add, change, suspend, or discontinue features of the Services at any time. We will use reasonable efforts to keep the Services available but do not guarantee uninterrupted or error-free operation, and we are not liable for any unavailability.

03 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services you represent that you meet this requirement, that the information you provide is accurate and complete, and that your use complies with all laws applicable to you.

04 Accounts & API keys

To access most features you must create an account. You are responsible for maintaining the confidentiality of your credentials, API keys, and session tokens, and for all activity that occurs under your account.

• Keep your password and API keys secret; treat each API key like a password.
• Notify us promptly at [email protected] if you suspect any unauthorized access or use.
• You may not share, sell, or transfer your account or API keys, or let others use them in violation of these Terms.

We are not liable for any loss arising from unauthorized use of your account that results from your failure to safeguard your credentials.

05 Acceptable use

You are responsible for how you use the Services and for the targets you choose to scrape. You agree that you will not use the Services to:

1. violate any applicable law, regulation, or third-party right;
2. access, scrape, or collect data from any site or system in violation of its terms of service, robots directives, or technical access controls, or where you are not authorized to do so;
3. collect, store, or process personal data without a lawful basis or the required consent, or in violation of any applicable privacy or data-protection law;
4. extract content for unlawful discrimination, harassment, stalking, surveillance, or to build profiles for purposes prohibited by law (for example, FCRA-regulated decisions you are not authorized to make);
5. infringe, misappropriate, or violate any intellectual-property, trade-secret, or proprietary right;
6. distribute malware, phishing content, or otherwise interfere with or compromise the integrity or security of any system or network;
7. circumvent, disable, or attempt to defeat any rate limit, credit metering, authentication, or other technical restriction of the Services;
8. reverse engineer, decompile, or attempt to derive the source code of the Services, except to the extent that restriction is prohibited by law;
9. resell, sublicense, or provide the Services to third parties as a competing offering, or use the Services to build a competing product;
10. impose an unreasonable or disproportionately large load on the Services or our infrastructure.

We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe violates these Terms or harms the Services, other users, or third parties.

06 Your content & responsibility

"Your Content" means the URLs, prompts, schemas, configurations, and other inputs you submit, and the data you extract using the Services. As between you and us, you retain your rights in Your Content.

You represent and warrant that you have all rights and permissions necessary to submit Your Content and to access and extract data from the targets you choose, and that your use of the Services and of the extracted data complies with all applicable laws and third-party terms. You are solely responsible for Your Content and for how you use the data you obtain through the Services.

You grant us a limited license to host, process, and transmit Your Content solely to provide, secure, and improve the Services for you, and to store request/response payloads as described in our Privacy Policy. We do not use Your Content to train machine-learning models.

07 Credits, billing & payments

The Services run on a credit-based model. Each request consumes a number of credits that depends on the endpoint and the features you use; some options (such as stealth/browser-based fetching) carry a surcharge, and some endpoints are priced dynamically. Credits are deducted on successful requests.

Refunds. Except where required by law, fees and credit purchases are non-refundable, and credits have no cash value. We may change our pricing prospectively; we will give reasonable advance notice of material changes that affect you, and changes will not apply to the billing period already paid for.

08 Intellectual property

The Services, including all software, models, designs, text, graphics, and documentation we provide, and all related intellectual-property rights, are owned by webscrape.ai or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them to improve the Services, without obligation to you.

09 Third parties & target sites

The Services interact with third-party websites and content that we do not own or control. We do not endorse, verify, or assume responsibility for any third-party content you access or extract, and your use of such content is at your own risk and subject to those third parties' terms and applicable law.

The Services may also rely on third-party providers (such as payment, email, and hosting providers). Your use of those features may be subject to the providers' own terms.

10 Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT EXTRACTED DATA WILL BE COMPLETE, ACCURATE, OR FIT FOR ANY PARTICULAR PURPOSE.

11 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBSCRAPE.AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12 Indemnification

You agree to defend, indemnify, and hold harmless webscrape.ai and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) Your Content and the data you extract; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party right, including the terms or rights of any site you target.

13 Suspension & termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if your use poses a risk to the Services or others, if required by law, or if we discontinue the Services.

Upon termination, your right to use the Services ceases. Sections that by their nature should survive termination — including those on your content responsibilities, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14 Changes to the terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Services or by email. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Terms.

15 Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which webscrape.ai is established, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction and venue of the courts located there for any dispute not subject to the procedures below.

Before filing a claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. To the extent permitted by law, disputes will be resolved on an individual basis, and you and webscrape.ai waive any right to participate in a class or representative action.

16 Copyright & DMCA

We respect intellectual-property rights and expect our users to do the same. If you believe content was accessed, copied, or made available through the Services in a way that infringes a copyright you own or control, you may send a notice under the Digital Millennium Copyright Act (DMCA) — or the equivalent law in your jurisdiction — to our designated agent at [email protected].

To be effective, your notice should include:

• identification of the copyrighted work you claim has been infringed;
• identification of the material claimed to be infringing, with information reasonably sufficient to locate it;
• your name, address, telephone number, and email address;
• a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf;
• your physical or electronic signature.

We will review valid notices and respond as required by law, which may include removing or disabling access to the material. If you believe your material was removed in error, you may submit a counter-notice to the same address. We maintain a repeat-infringer policy and may suspend or terminate, without notice, the accounts of users who repeatedly infringe the rights of others.

17 General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede prior agreements on the subject.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
